Terms of service

These Terms of Service (“Terms”) form a binding agreement between you and Forkly for your use of our website, dashboard, redirect service, QR codes and API (together, the “Service”). If you use the Service on behalf of an organisation, you confirm you are authorised to accept these Terms for it, and “you” refers to that organisation. If you do not agree, do not use the Service.

• You must be at least 16 years old and provide accurate information, including a valid email address you verify.
• You are responsible for keeping your credentials and API keys secret and for all activity under your account and workspaces.
• Workspace owners control membership and roles. Members act on behalf of the workspace owner, who is responsible for their use of the Service.
• Tell us immediately at support@forkly.dev if you suspect unauthorised access.

You must comply with our Acceptable Use Policy, which forms part of these Terms. In short: links, QR codes and destinations must never be used for phishing, malware, spam, fraud, illegal content or to deceive the people who open them.

You keep all rights to the links, destinations, logos and other content you add (“Customer Content”). You grant Forkly a limited licence to host, process and display Customer Content solely to provide and secure the Service.

You are responsible for Customer Content and for having the rights to use any trademarks, logos and destinations you link to. We do not endorse the destinations of our customers’ links.

• Paid plans are billed in advance monthly or yearly and renew automatically until cancelled.
• Trials convert to a paid subscription at the end of the trial unless you cancel before then.
• You can cancel at any time; your plan stays active until the end of the current billing period. Except where required by law, payments are non-refundable.
• If a payment fails we may downgrade the workspace to the Free plan after reasonable notice.
• We may change prices with at least 30 days’ notice. Changes take effect at your next renewal.
• Prices exclude taxes, which are added where applicable.

Each plan includes the limits shown on our pricing page. Traffic through your links is not metered, but we may throttle or block traffic that threatens the stability or security of the Service, such as denial-of-service attacks or automated abuse. API usage is subject to the rate limits in our API documentation.

You may connect only domains you own or are authorised to use. You are responsible for your DNS configuration and for keeping the verification and routing records in place. We may disable a custom domain that is used in breach of these Terms or no longer points to the Service.

API access is available on eligible plans. You must not use the API to exceed plan limits, circumvent security controls or build a service that resells Forkly without our written permission. We may change the API with reasonable notice and will try to avoid breaking changes.

We may suspend or disable individual links, domains, workspaces or accounts, with or without notice, if we reasonably believe they violate these Terms or the Acceptable Use Policy, create risk for other users or the public, or if we are required to by law.

You may stop using the Service and delete your account at any time. On termination your links stop redirecting and your data is deleted as described in our Privacy Policy.

We work hard to keep the Service fast and available, but we provide it without a guaranteed uptime unless agreed in writing. We may add, change or remove features; if we remove a material paid feature we will give reasonable notice.

The Service, including its software, design and branding, belongs to Forkly and its licensors. These Terms do not grant you any rights to our trademarks. Feedback you send us may be used without obligation to you.

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that routing decisions, device detection or analytics will be error-free.

To the extent permitted by law, Forkly will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim, or USD 100 if greater. Nothing in these Terms limits liability that cannot be limited by law.

You will defend and indemnify Forkly against claims arising from your Customer Content, your destinations or your breach of these Terms.

• We may update these Terms. Material changes will be notified by email or in the dashboard at least 30 days in advance; continued use means acceptance.
• If any provision is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver.
• You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition.
